Terms of Use
Effective date: September 26, 2026
These Terms of Use (“Terms”) govern your use of the Viral Factory iOS app and this website (together, the “Service”), provided by Rıdvan Uyan (“we”, “us”). By downloading, accessing or using the Service, you agree to these Terms.
The service
Viral Factory generates short-form content — video, images and captions — from prompts and reference material you provide, using third-party AI models. Generated output may be inaccurate, unexpected or unsuitable for your purpose; you are responsible for reviewing it before you publish or rely on it.
Apple’s licensing terms
Auto-renewable subscriptions purchased through the App Store are also governed by Apple’s Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. If these Terms conflict with that agreement on a subscription or purchase matter, Apple’s agreement governs.
Acceptable use
You agree not to use the Service to:
- generate or distribute illegal content, or content that infringes someone else’s copyright, trademark, publicity or other rights;
- depict a real, identifiable person without their consent — including through the Cameo, AI character, or remake features;
- impersonate any person or organization, or generate content designed to deceive;
- generate sexual content involving minors under any circumstances — we have zero tolerance for this and will report it to the relevant authorities;
- harass, defame, or threaten any person;
- attempt to disrupt, reverse-engineer or abuse the Service, or circumvent credit limits or rate limits.
Your content and other people’s likeness
You keep ownership of the prompts, media you upload, and content you generate. You must own the rights to, or have permission to use, anything you upload — a photo, a video, a reel link. You grant us a limited license to process, store and transmit that content solely to provide the Service, including sending it to fal.ai and its model providers as described in our Privacy Policy. You are solely responsible for reviewing generated output and for how you use, publish or promote it, including complying with each social platform’s own rules when you publish through the Service.
AI output disclaimer
Content is generated by AI and may be inaccurate, low-quality, or coincidentally resemble other content. We do not guarantee any particular result, engagement or performance. You are responsible for fact-checking and for any legal review needed before you publish generated content.
Credits, purchases and subscriptions
- Generating content consumes credits; the cost is shown in the app before you generate.
- One-time credit packs do not expire unless stated otherwise at the time of purchase.
- Subscription plans include a credit allowance that refreshes each billing period; unused subscription credits do not roll over to the next period.
- Subscriptions automatically renew for the same term at the then-current price unless cancelled at least 24 hours before the end of the current period. Manage or cancel any time in Settings → [your name] → Subscriptions on your device — see our Support page.
- Except where required by law, all purchases are non-refundable; refund requests for App Store purchases are handled by Apple.
Termination
You may stop using the Service and delete your account at any time — see our Delete Account page. We may suspend or terminate your access for violating these Terms, misusing credits, fraud, or abuse of the Service, with or without notice.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or USD 20.
Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. If you are a consumer habitually resident in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer-protection laws, this section does not deprive you of the protection of those mandatory laws or of your right to bring proceedings in your local courts.
Changes to these Terms
We may update these Terms from time to time; continued use of the Service after a change means you accept the update. We will update the effective date above.
